This website is managed by Rose Chocolates. In these terms and conditions, the terms “we”, “us” and “our” refer to Rose Chocolates.  

“Dispatch Confirmation” – refers to acceptance and confirmation of your order;

“Order” – refers to your order of chocolates. 

By visiting Rose Chocolates website and/ or purchasing something from us, you are engaging and agreeing with the following terms and conditions.  This applies to all service users in of the site, including without limitation users who are browsers, customers, merchants, and/ or contributors of content.

Please read the following Terms of Condition carefully before using our website. 

Our website is hosted on WordPress. WordPress provides us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1

Access and use of our site

 Our Site is free of charge.  We may, stop, change, discontinue our sites or any parts of it at any time and this can be without notice.  If this occurs we are not liable to you if our site or any part of is it is not accessible at anytime or any period. 

Consumers of Rose Chocolates website may only purchase chocolates containing alcohol if aged 18 and over. 

SECTION 2 

Conditions

We at Rose Chocolates have the right to refuse service to anyone at any time. 

All content in our site, including but not limited to text, graphics, logos, images, data, page layout is Rose Chocolates property.  By accessing and using our site you are agreeing and acknowledging to this.  You can not reproduce, copy, or distribute any content from our site without written permission from our representatives. 

Accessing our site you understand that your content (not including account/credit card information), may be transferred unencrypted and involve

 (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

SECTION 3 

Accuracy of information 

We are not responsible if information made available on this site is not accurate or current . The content on Rose Chocolates is provided only for general information and should not be relied or referred upon or used as the sole basis for making final decisions without consulting  further sources of information. Any reliance on the material on this site is at your own risk.

You agree that it is your responsibility to monitor any changes to our site.

SECTION 4

Prices, goods/products and availability 

Images of our chocolates are for display, content and illustrative purposes only.  Therefore there may be variations in: colour, texture, design between the image and the product sold, due to chocolates being handmade (therefore each product has a slight difference to it) and variations in computer displays and lighting.

Images and/or descriptions of packaging are for illustrative purposes only, the actual packaging of chocolates may vary.

All chocolates are made in the same environment as nuts and other allergens, so we cannot guarantee they are free from nut traces.  We take extra care to make our chocolates separately from our chocolates containing allergens and are packaged separately. 

We make all efforts to ensure that the prices displayed on our site is correct at the time of going online.  We reserve the right to change prices at any given time, or remove any special offers and discounts.  Changes of the price will not affect orders that have already been placed.  All prices are checked regularly by us.   Any problems with pricing on your order we will contact you and ask how you would like to proceed further with your order.  We will not process your order until you respond.  If we do not receive a response from you within 14 days, we will treat your order as cancelled and notify you in writing. 

SECTION 5 

Orders, Products,  Services and Delivery 

Certain products or services may have limited quantities and are subject to exchange or return according to our return policy. 

Rose Chocolates will guide you through the ordering process.  Before submitting your order you will when the opportunity to review your order and amend it, please use this time to check your order carefully before completing your order.

 Our acknowledgement of receipt of your Order does not mean that we have accepted your order.   Acceptance is indicated by us when sending you a Dispatch Confirmation by email.  Once received this dispatch confirmation your order has been accepted. 

 Dispatch Confirmations shall contain the following information:

  • Confirmation of the chocolates ordered 
  •  Pricing of Goods ordered including, where appropriate; delivery and other additional charges

If we, for any reason, do not accept or cannot fulfil your Order, no payment shall be taken under normal circumstances.  If payment has been taken this will be refunded to you as soon as possible and in any event within 14 days.

You agree to provide current, complete and accurate purchase and account information for all purchases made on our website. 

Delivery

Look at our delivery policy for more information. 

If We are unable to deliver the Goods on the delivery date  (for example, no one is available at your address to receive the goods). We will follow any delivery instruction you may have given or attempt to leave your goods in a safe place. If this is not possible, our carrier will leave a note advising of where your goods have been returned to, and how to either arrange re-delivery or collect them.

Ownership of the chocolates passes onto you once we have received payment

None of Rose Chocolates Products are for resale.

SECTION  6 

Optional tools/links 

We may provide you with access to third party tools/links,  we neither monitor or have any control or input of these third party tools. Therefore do not take any liability of using these third parties. This will be at your own risk for your to ensure you approve of any terms provided by these third party providers.

User comments or feedback 

If you send any certain specific submissions without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine as offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable. 

Using our site you agree that your comments will not violate any right of any third-party. You further agree that your comments will not contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You cannot use a false e-mail address or pretend to be someone other than yourself, or mislead us or third-parties as to the origin of any comments. You are  solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Events out of our control and prohibited use (Force Majeure)

We are not liable for any failure or delay where that failure or delay results from any cause that is beyond our control.  Or any unforeseeable circumstances that prevent from fulfilling a contract:  such causes include, but are not limited to: pandemics, power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, or any other event that is beyond our reasonable control.

Prohibited use 

In addition to other prohibitions in these terms of conditions you are prohibited from using Rose Chocolates for any unlawful purpose or to violate any rules, laws, or local ordinances, or violate our intellectual property rights or the intellectual property rights of others, to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability, to submit false or misleading information, to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, and third parties, or to collect or track the personal information of others.

Terms for events 

Payment must be made at time of booking.

Any events hosted by Rose Chocolates we reserve the rights to cancel or amend without notice.  We will contact our customers by email/ and or telephone if this occurs.
